The 501(c)(3) Protection Act

Article I—Staff Safeguard Act

Section 1. Purpose and Authority

Under the federal 501(c)(3) designation of GCPTALKS, Inc., the organization shall adopt and enforce the Staff Safeguard Act, establishing mandatory protections for all individuals serving the nonprofit. This includes employees, volunteers, department leaders, executive officers, ambassadors, and members of the Board of Directors.

Section 2. Organizational Responsibility

The Founder and President, in partnership with the Board of Directors, Vice President, Assistant Vice President, Executive Ambassadors, and Executive Office Manager, shall ensure:

  • A safe, respectful, and harassment‑free workplace.

  • Protection of all staff from threats, violence, intimidation, and misconduct.

  • Oversight of staff well‑being as a shared executive responsibility.

Section 3. Mission Workforce Protection

All staff members are recognized as the operational force of the organization’s mission. Their safety, dignity, and well‑being are essential to the functioning of GCPTALKS, Inc., and Garth Charity Projects, Inc. The organization shall maintain policies, procedures, and safeguards to uphold these protections.

Article II—501(c) (3) Nonprofit Protection Act

Section 1. Workplace Safety Standards

GCPTALKS, Inc. shall maintain a safe working environment for all personnel, ensuring:

  • Freedom from harassment, discrimination, and retaliation.

  • Protection from violence, threats, fraud, and misconduct.

  • Fair treatment of all staff, including volunteers.

Section 2. Protection of Organizational Stakeholders

The organization shall safeguard:

  • Donors and sponsors

  • Vendors and investors

  • Awareness clients and community partners

No individual shall engage in conduct that endangers or undermines the integrity of the organization or its personnel.

Section 3. Violation Review Process

All violation cases shall be reviewed by the following oversight bodies:

  • Executive Office Manager

  • Assistant Vice President

  • Special Vice President

  • Executive Office Ambassador

  • Ambassador General Secretary

  • Senior Vice President

  • Executive Vice Board of Directors

  • Founder and President of the Review Board

These bodies shall ensure due process, documentation, and corrective action.

Article III—Federal Nonprofit Staff Protection Bill

Section 1. Legislative Intent

GCPTALKS, Inc., proposes that Congress and the Senate recognize a Federal Nonprofit Staff Protection Bill, establishing nonprofit workers as protected personnel under federal law.

Section 2. Legal Protections Requested

The bill shall:

  • Classify nonprofit staff as protected individuals under federal and state law.

  • Establish penalties, fines, and potential imprisonment for threats, violence, or harassment against nonprofit workers.

  • Require public awareness of nonprofit worker protections.

Section 3. Facility Security Requirements

GCPTALKS, Inc. shall ensure:

  • Security personnel are present when necessary.

  • Facilities remain guarded and monitored.

  • Staff safety is prioritized at all operational locations.

Article IV—Staff Meal Act of Kindness

Section 1. Purpose

The Staff Meal Act of Kindness ensures that GCPTALKS, Inc. provides nutritional support and wellness accommodations for staff.

Section 2. Meal and Snack Program

The organization shall:

  • Provide a designated lunch space at all facilities.

  • Offer a monthly staff meal funded by the nonprofit.

  • Maintain a snack package program for on‑site staff.

  • Promote a healthy workplace environment.

Section 3. Administrative Oversight

This program shall be overseen by:

  • Founder and President

  • Board of Directors

  • Executive Office Ambassadors

  • Brand Ambassadors

Article V—Staff Bonus Boost Act

Section 1. Purpose

The Staff Bonus Boost Act provides holiday and seasonal incentive bonuses to staff members.

Section 2. Eligible Bonus Periods

Bonuses may be issued during:

  • Easter

  • Fourth of July

  • Labor Day

  • Thanksgiving

  • Christmas

  • New York Bonus Season

Section 3. Funding Sources

The program may be funded through:

  • Grants

  • Fundraising events

  • Brand partnerships

  • Investor and sponsor support

  • Donor contributions

  • Retail collaborations

Section 4. Administrative Oversight

The program shall be managed by:

  • Board of Directors

  • Founder and President

  • Executive Office Ambassadors

  • Brand Ambassadors

  • Outreach Director

  • Marketing Director (fundraising manager)

Section 5. Additional Staff Benefits

Under this act, GCPTALKS, Inc. shall also provide:

  • Vacation and sick time

  • Insurance programs

  • Family incentive packages

  • Bereavement care packages for families of deceased staff members

Certification

These bylaws constitute the official 501(c)(3) Protection Act Addendum of GCPTALKS, Inc., a federal charitable arts and culture entity established on April 30, 2019.
